MOBILE RESIDENTIAL REAL ESTATE CLOSING ATTORNEY

 

  • As a mobile real estate lawyer and closing agent, David Chandler conducts your residential real estate closings in your home (refi) or in the office of the Realtor or mortgage lender*; 
  • The focus of his law practice is conducting residential real estate closings.  David Chandler is not a litigator and is not confined by court calendars;
  • Realtors and mortage lenders can schedule closings after hours or on days when court is in session;
  • David Chandler is involved with every aspect of the closing process so that your closing can proceed smoothly and quickly;
  • Title Searches are conducted by our office and any title issues are cleared by us, if possible, which often results in a faster turn around time; 
  • The State of Georgia requires a Georgia licensed attorney to conduct all real estate closings.**  As a mobile attorney, David Chandler is willing to travel to your location to conduct the closing, without additional fees, saving you and your borrower/purchaser time and money;
  • Conducting the closing at the Realtor's office, the mortgage lender's office, or at the borrower's home (refi) allows the closing to take place in a setting where your client feels more relaxed, comfortable, and feels in control of the situation.

*  Georgia requires that the grantee/grantor or affiant signatures on recorded documents be attested by both a Notary Public and an Unofficial Witness (the notary cannot serve as both).  The notary service is provided by my office, however, the borrower, agent, mortgage broker or lender must provide a witness at closing.  The witness cannot be a family member to any party to the transaction and cannot be a party to the transaction.  If the closing is a refinance and is closing in the borrower's home, please inform your client of this detail so they can have a neighbor or friend standing ready to witness the recordable documents.
 
**According to my understanding of recent Supreme Court decisions and Advisory Opinions, all real estate closings, both for purchase or refinance, must be overseen by a Georgia attorney.  The Attorney is required to  a.)certify the title; b.)personally oversee the closing process, including the signing of documents; c.)collect all funds and disburse all funds through an IOLTA (specific type of trust account required by the State of Georgia); d.) have the deeds and any affidavits properly recorded.  A non-attorney, including notaries, who conduct a closing may be found to be guilty of the Unauthorized Practice of Law (UPL) and subject to civil liability, and, a duly licensed Georgia attorney who aids another in the UPL may be subject to discipline by the State Bar of Georgia and civil liability.
