AS SOON AS THE CONTRACT IS EXECUTED:
THE BUYER (or Realtor) SHOULD FORWARD THE FOLLOWING TO MY OFFICE (FAX 864-287-9200)
- Full name(s) as they wish them to appear on their Warranty Deed (typically this should match their Driver's License)
- Fully executed (signed) copy of the Sales Contract with all addenda and exhibits
- Copy of the purchaser(s) Driver's License(s)
- Copy of the new Survey ***
- Current legal residence address
- Contact numbers (home, work and cell numbers)
- Email address
TO HELP THE CLOSING PROCESS MOVE SMOOTHLY
- Buyer should order all inspections immediately
- Funds from the lender and funds due from the purchaser must be wired to my Trust Account the day BEFORE closing (wired funds can take up to 24 hours to clear) this obviously means all fees and charges must be forwarded and that we must complete the Settlement Statement the day prior to closing. (Certified Checks not currently acceptable pursuant to current Title Company guidelines)
- Buyer should plan to purchase an Owner's Title Policy at closing. The Lender's Policy does not cover the purchaser's equity. This is a one-time premium. For more information about title insurance, click here.
- Prior to closing, make sure all contract issues are resolved. Contract disputes cannot be remedied at the closing table.
BUYER SHOULD BRING TO CLOSING:
- Driver's License and Social Security Card for each person shown on title (deed) and/or on the loan
- Every person that will be on title must come to the Closing unless a Power of Attorney specific to the subject property is prepared by my office and then executed at another Attorney's Law Office.
- Proof of Homeowner's insurance with Paid Receipt (or fax the Binder and Invoice several days prior to closing)
- All original documentation that the lender has told you to bring to closing
- Fully executed original copy of the Sales Contract with all addenda, attachments and exhibits for our file
REFINANCING BORROWER:
THE BORROWER OR THE MORTGAGE LENDER (or broker) SHOULD FORWARD THE FOLLOWING TO MY OFFICE (along with the Title Binder order):
- Payoff information (account number, payoffs contact number, Social Security numbers, Lender's payoff address) (Note: The broker or borrower may request the payoff, this usually avoids us having to obtain a signed release from the borrower. Some lenders provide automated payoffs, the payoff must be faxed directly from the lender to my office 864-287-1060). Please remember that the payoff amount is not just the principle amount still owed;
- Full legal description (unless you fax us a copy of the deed);
- Proof of Homeowner's insurance with Paid Receipt (or fax the Binder and Invoice several days prior to closing), also the Insurance Agent's name, address and phone number. Most lender's require that insurance be paid 12 months in advance;

BRING TO CLOSING
- Driver's License(s), Social Security Card(s), and any documentation the lender told you to bring to closing;
- All grantees that are shown on the Warranty Deed must come to closing, even if they are not all on the loan;
- Note: If your current survey is old or is not adequate for certification of title a new survey may be required.
***A new survey is recommended when property is being purchased to avoid exceptions on the title insurance policy. Without a recent survey the purchaser is never sure of what he/she owns or where an encroachment may exist. Also note that if the current recorded Survey does not include the required information a new survey will be required since an adequate survey is necessary for certification of title. A new survey can take several weeks to complete so I urge you to order it as soon as any contract contingencies are removed. A copy of the new survey should be faxed to my office and three originals brought to closing for recording.
